Higher pay for workers on Chinese New Year

Workers in the private sector who will report for work on February 5, Chinese New Year which is a special non-working holiday, are entitled to receive additional 30 percent of their daily rate wages, the labor department said.
 
Pursuant to Proclamation No. 555, s. 2018, signed by President Rodrigo Duterte declaring February 5, 2019 as a special non-working holiday in celebration of the Chinese New Year, Labor Secretary Silvestre Bello III released Labor Advisory No. 15, series of 2018 prescribing the payment of rules for the said holiday. 
 
Employers in the private sector are reminded to observe the following rules on the payment of wages for the said special non-working holiday:
 
For work done during the special day, he/she shall be paid an additional 30 percent of his/her daily rate on the first eight hours of work [(Daily rate x 130 percent) + COLA], however, If the employee did not work, the no "work, no pay" principle shall apply unless there is favorable company policy, practice or collective bargaining agreement (CBA) granting payment on a special day.
 
For those who worked in excess of eight hours (overtime work), the employee shall be paid an additional 30 percent of his/her hourly rate on said day (Hourly rate of the basic daily wage x 130 percent x 130 percent x number of hours worked).
 
If the employee went to work during the special days that also falls on his/her rest day, he/she will be getting an additional 50 percent of his/her daily rate on the first eight hours of work [(Daily rate x 150 percent) + COLA].
 
For work done in excess of eight hours (overtime work) during a special day that also falls on his/her rest day, he/she shall be paid an additional 30 percent of his/her hourly rate on said day (Hourly rate of the basic daily wage x 150 percent x 130 percent x number of hours worked).
